In a series of three behavioral experiments, we found a systematic distortion of probability judgments concerning elementary visual stimuli. Participants were briefly shown a set of figures that had two features (e.g., a geometric shape and a color) with two possible values each (e.g., triangle or circle and black or white). A figure was then drawn, and participants were informed about the value of one of its features (e.g., that the figure was a “circle”) and had to predict the value (...) of the other feature (e.g., whether the figure was “black” or “white”). We repeated this procedure for various sets of figures and, by varying the statistical association between features in the sets, we manipulated the probability of a feature given the evidence of another (e.g., the posterior probability of hypothesis “black” given the evidence “circle”) as well as the support provided by a feature to another (e.g., the impact, or confirmation, of evidence “circle” on the hypothesis “black”). Results indicated that participants’ judgments were deeply affected by impact, although they only should have depended on the probability distributions over the features, and that the dissociation between evidential impact and posterior probability increased the number of errors. The implications of these findings for lower and higher level cognitive models are discussed. (shrink)

The current disclosure model of informed consent ignores the linguistic complexity of any act of communication, and the increased risk of difficulties in the special circumstances of informed consent. This article explores, through linguistic analysis, the specificity of informed consent as a speech act, a communication act, and a form of dialogue, following on the theories of J.L. Austin, Roman Jakobson, and Mikhail Bakhtin, respectively. In the proposed model, informed consent is a performative speech act resulting from a series of (...) communication acts which together constitute a dialogic, polyphonic, heteroglossial discourse. It is an act of speech that results in action being taken after a conversation has happened where distinct individuals, multiple voices, and multiple perspectives have been respected, and convention observed and recognized. It is more meaningful and more ethical for both patient and physician, in all their human facets including their interconnectedness. This is a study of the effects of a number of background variables on ethical perceptions of Mexican and U.S. marketers. This research investigates how a marketer’s personal religiousness, relativism, and the ethical values influence in perceptions of the degree of ethical problems in hypothetical marketing scenarios. It also examines differences between Mexican and U.S. marketers on these variables. The results show significant differences in perception between the countries, and we discuss the implications of these differences for cross-cultural business activities.

The critical discourse analysis is the tool used in this article, to study how audiovisual media have constructed mental representation about the historical facts occurred in Spain between the final stage of the Spanish Civil War and the late 1980s: the theft of newborn babies. The State has failed in an attempt to establish policies that support truth, justice and reparation as it has been recalled by United Nations experts to the Government of Spain, and the reports and documentaries have (...) become vehicles to capture and recover memories. Our objective is to analyze how this collective awareness has been realized and the contribution of reports and documentaries. Our results show that the Spanish television channels silence the Francoist context to depict the thefts as the product of economical mobs focused on child trafficking. The international channels, however, put the origin of the dictatorship at the center of the discourse. (shrink)

Differences in Common engages in the ongoing debate on ‘community’ focusing on its philosophical and political aspects through a gendered perspective. It explores the subversive and enriching potential of the concept of community, as seen from the perspective of heterogeneity and distance, and not from homogeneity and fused adhesions. This theoretical reflection is, in most of the essays included here, based on the analysis of literary and filmic texts, which, due to their irreducible singularity, teach us to think without being (...) tied, or needing to resort, to commonplaces. Philosophers such as Arendt, Blanchot, Foucault, Agamben or Derrida have made seminal reflections on community, often inspired by contemporary historical events and sometimes questioning the term itself. More recently, thinkers like Judith Butler, Gayatri Spivak or Rada Ivekovic—included in this volume are essays by all three—have emphasized the gender bias in the debate, also problematizing the notion of community. Most of the essays gathered in Differences in Common conceive community not as the affirmation of several properties which would unite us to other similar individuals, but as the “expropriation” of ourselves (Esposito), in an intimate diaspora. Community does not fill the gap between subjects but places itself in this gap or void. This conception stresses the subject’s vulnerability, a topic which is also central to this volume. The body of community is thus opened by a “wound” (Cixous) which exposes us to the contagion of otherness. The essays collected here reflect on different topics related to these issues, such as: gender and nation; nationalism, internationalism, transnationalism; nationalism’s naturalization of citizenship and the exclusion of women from citizenship; the violent consequences of a gendered nation on women’s bodies; gendering community; preservation of difference(s) within the community; bodily vulnerability and new politics; community and mourning; community and the politics of memory; fiction, historical truth and (fake) documentary; love, relationality and community; interpretive communities and virtual communities on the Web, among others. The Fairness, Accountability, and Transparency (FAccT) literature tends to focus on bias as a problem that requires ex post solutions (e.g. fairness metrics), rather than addressing the underlying social and technical conditions that (re)produce it. In this article, we propose a complementary strategy that uses genealogy as a constructive, epistemic critique to explain algorithmic bias in terms of the conditions that enable it. We focus on XAI feature attributions (Shapley values) and counterfactual approaches as potential tools to gauge these conditions (...) and offer two main contributions. One is constructive: we develop a theoretical framework to classify these approaches according to their relevance for bias as evidence of social disparities. We draw on Pearl’s ladder of causation (Causality: models, reasoning, and inference. Cambridge University Press, Cambridge, 2000, Causality, 2nd edn. Cambridge University Press, Cambridge, 2009. doi:10.1017/CBO9780511803161) to order these XAI approaches concerning their ability to answer fairness-relevant questions and identify fairness-relevant solutions. The other contribution is critical: we evaluate these approaches in terms of their assumptions about the role of protected characteristics in discriminatory outcomes. We achieve this by building on Kohler-Hausmann’s (Northwest Univ Law Rev 113(5):1163–1227, 2019) constructivist theory of discrimination. We derive three recommendations for XAI practitioners to develop and AI policymakers to regulate tools that address algorithmic bias in its conditions and hence mitigate its future occurrence. The author presents Gernot Böhme’s median mode of being theory, which attempts to find an anthropological middle ground between the rational and the irrational, the spiritual and the corporeal and the active and passive in human experience. Böhme’s reflections on the median mode of being are normative in character and linked to the concept of “sovereign man,” which he strongly defends and whose main characteristics Hoffmann outlines in the first part of the essay. Among others, Hoffmann argues against Böhme’s excessive (...) emphasis on the controlling/restrictive functions of awareness at the cost of those functions which serve to protect and stimulate life, his non-distinction between the distance to a cognized object and its intellectual instrumentalisation, and his rather one-sided tendency to seek the sources of European rationalism in the Socra-tean tradition. Summary The genealogy of observation as a philosophical term goes back to the ancient Greek astronomical and medical traditions, and the revival of the concept in the Renaissance also happened in the astronomical and medical context. This essay focuses primarily on the medical genealogy of the concept of observation. In ancient Greek culture, an elaboration of the concept of observation (tērēsis) first emerged in the Hellenistic age with the medical sect of the Empirics, to be further developed by the ancient (...) Sceptics. Basically unknown in the Middle Ages, the Empirics’ conceptualisation of tērēsis trickled back into Western medicine in the fourteenth century, but its meaning seems to have been fully recovered by European scholars only in the 1560s, concomitantly with the first Latin translation of the works of Sextus Empiricus. As a category originally associated with medical Scepticism, observatio was a new entry in early modern philosophy. Although the term gained wide currency in general scholarly usage in the seventeenth century, its assimilation into standard philosophical language was very slow. In fact, observatio does not even appear as an entry in the philosophical dictionaries until the eighteenth century—with one significant exception, the medical lexica, which featured the lemma, reporting its ancient Empiric definition, as early as 1564. Sometimes subjects have sufficient internal and external resources to retrieve information stored in memory, in particular information that carries socially charged content. Yet, they fail to do so: they forget it. These cases pose an explanatory challenge to common explanations of forgetting in cognitive science. In this paper, I take this challenge and develop a new explanation of these cases. According to this explanation, these cases are best explained as cases of norm-induced forgetting: cases in which forgetting is caused by (...) social norms in a relevant sense. These cases draw attention to the normative aspects of the mechanisms of forgetting. This is an important but neglected aspect of cases of everyday forgetting, in particular of those characterized by a social dimension. By investigating some ways in which the psychology of social norms is causally relevant in the mechanisms of retrieval failure, I begin to fill this gap. (shrink)

The central idea behind this paper is that presuppositions of soft triggers arise from the way our attention structures the informational content of a sentence. Some aspects of the information conveyed are such that we pay attention to them by default, even in the absence of contextual information. On the other hand, contextual cues or conversational goals can divert attention to types of information that we would not pay attention to by default. Either way, whatever we do not pay attention (...) to, be it by default, or in context, is what ends up presupposed by soft triggers. This paper attempts to predict what information in the sentence is likely to end up being the main point (i.e. what we pay attention to) and what information is independent from this, and therefore likely presupposed. It is proposed that this can be calculated by making reference to event times. The notion of aboutness used to calculate independence is based on that of Demolombe and Fariñas del Cerro (In: Holdobler S (ed) Intellectics and computational logic: papers in honor of Wolfgang Bibel, 2000). Over the last three decades, non-adaptationism has developed as an alternative model to more traditional, adaptationist approaches within Evolutionary Epistemology. Despite its great explanatory strength, non-adaptationist EE finds a potential Achilles heel in its adherence to conceptual relativism, namely the idea that empirical content can be relative to many different and radically incommensurable conceptual schemes. In his seminal essay “On the Very Idea of a Conceptual Scheme”, Donald Davidson did in fact prove the unintelligibility of an analogous form of conceptual (...) relativism. Although Davidson’s original intent was to debunk a conceptual relativist position which he discerned in the works of authors such as Kuhn, Quine, and Whorf, given the apparent similarity between the conceptual relativism supported by non-adaptationist EE and the one criticised by Davidson, one might well wonder if Davidson’s objections would have the same debunking effect if applied to non-adaptationist EE. In this paper I propose to answer this question by directing Davidson’s critiques of conceptual relativism to non-adaptationist EE and by testing to what extent the latter is de facto undermined by Davidson’s attacks. I demonstrate that Davidson’s arguments do not detract from the reliability of non-adaptationist perspectives and, to some extent, they appear to substantiate the non-adaptationist evolutionary epistemological cause anew. Some presuppositions are easier to cancel than others in embedded contexts. This contrast has been used as evidence for distinguishing two fundamentally different kinds of presuppositions, ‘soft’ and ‘hard’. ‘Soft’ presuppositions are usually assumed to arise in a pragmatic way, while ‘hard’ presuppositions are thought to be genuine semantic presuppositions. This paper argues against such a distinction and proposes to derive the difference in cancellation from inherent differences in how presupposition triggers interact with the context: their focus sensitivity, anaphoricity, and (...) question–answer congruence properties. The paper also aims to derive the presuppositions of additive particles such as too, also, again, and of it-clefts. (shrink)

This paper examines a little studied type of perspective shift that I call protagonist projection, following Holton :625–628, 1997). PP is a way of describing the mental state of a protagonist that conveys, to some extent, her perspective. Similarly to its better known cousin free indirect discourse, the shift in perspective is achieved without an overt operator. Unlike FID, PP is not based on a presumed speech-act of a protagonist. Rather, it gives a linguistic form to pre-verbal perceptual content, sensations, (...) feelings or implicit beliefs. I propose to analyse PP in a bi-contextual framework, extending Eckardt’s approach to FID. Under the resulting analysis, FID and PP are two instances of a more general category of perspective shift. The field of modern logic is too extensive to be worked through by open cast mining. To open it up, we need to sink shafts and construct adits. This is the method of most text books: a systematic exposition of a number of main topics, supplemented by exercises to teach skill in the appurtenant techniques, lays a secure foundation for subsequent dis cussion of selected questions. Compared with this, the present treatment is more like a network of exploratory drillings to (...) show that it would be worthwhile to start mining operations, or to work the existing shafts and adits, as the case may be. Within this metaphor we may also describe the inherent weakness of this conception: once a cavity is pierced, the duct's capacity will in general not be sufficient to carry away the discovered riches. But whether we are concerned with a new or an already worked mine - at any rate, the experience should stimulate us into either reviving an existing system of shafts or even, in particularly fortunate cases, designing a new ap proach. In the early decades of the 20th century, women's access to the historical discipline followed fundamentally two paths. For the first time, some (a small minority) entered the profession as academic historians; others worked outside or on the margins of academia, pursuing their research interests as independent scholars. What did being an independent scholar mean for these women? Was it always a form of externally imposed marginalization? My paper argues that this is not the case. First of all, being an (...) independent scholar did not necessarily mean marginality. Some of these women scholars exerted a deep influence on 20th century historiography, and their work is still influential today. Quite apart from posthumous fame, moreover, it should be noted that the lack of academic affiliation did not necessarily preclude for some of these women the possibility of recognition and influence during their lives. Secondly, we should be careful not to assume that being an independent scholar was invariably an externally imposed marginalization. Some of these women scholars can be defined as ‘obligatory amateurs,’ because they were frustrated in their attempt to pursue an academic career. But others, in contrast, deliberately chose independent scholarship over an academic job, and can thus be defined ‘amateurs by choice.’ What was the motivation behind this choice? I argue that an important factor was the resilience of the amateur tradition in historical writing. The amateur tradition offered a strong counterbalance to women's marginality in academia and a source of positive values and models for their participation in the intellectual life. (shrink)

There is currently a consensus among comparative psychologists that nonhuman animals are capable of some forms of mindreading. Several philosophers and psychologists have criticized this consensus, however, arguing that there is a “logical problem” with the experimental approach used to test for mindreading in nonhuman animals. I argue that the logical problem is no more than a version of the general skeptical problem known as the theoretician’s dilemma.
